| Abstract | الملخص : في ظل تطور التكنولوجيا، وحداثة التقنيات المســــــتخدمة في النشــــــر الإلكتروني، وصــــــعوبة بيان الحد الفاصــل بين حرية الرأي والتعبير الذي كفلته دســاتير العالم من جانب، وعدم انتهاك خصـوصــية الأفرد والإعتداء على حقوقهم من جانب آخر تظهر مشكلة الدراسة في التكيف القانوني للتعويض عن الضرر اســــــــة في التكييف القانوني للتوالاعتداء على حقوقخم من جانع آير، تظخر مشــــــــالة الدرعويض عن افية و الطا فية،الضــــرر وفح الأحاات العامة للمســــؤولية المدنية المُتمرل في نشــــر ما رحه ُ على الكر اد، التشــخير، تشــويد الســُ معة، الســع، الق ف، الاعتداء على الملكيةالاعتداء على الحياة الخاصــة لرفر الفكرية، و نشــــر ما رُخالن النظات العات والقواعد العامة، إلاهاعن قةــــور ن ه ه القوانين قد كشــــف النســــبي في مواكبة حداثة ه ه التقنية، و ظخرت الحاجة إلى تعديلخا يما يواكع التطور المُســــتمر، وتم إلى مافية النشــــــر اســــــة في الفةــــــل الأوالدر اســــــة الوصــــــفي والمقارن، وتناولاعتماد منخج الدر الإلكتروني وآليتد، ثم حاات المســـؤولية المدنيةالمُترتبة على النشـــر الإلكتروني ثم دعول المســـؤولية اســــة إلى متموعة من التوصــــياتالدر ار التي رُســــببخا النشــــر الإلكتروني، وانتخالمدنية عن الأضــــر بتحديه قانون الةــحافة والطباعة والنشــر، ليشــمل الةــحافة الالكترونية، وتحديد جخة مختةــة لرقاية محتول المواقد الإلكترونية يالإضــافة إلى فرر رقاية دا مة، وتحديد محامة وقضــاة مختةــينةلِمُباشــر ّ اا دعوة المُشـــــرا من المحاكم المدنية يشـــــال عات، و ييردَعَاول التعويض عن النشـــــر الإلكتروني بدلا لتعديل المادة (60) من قانون رقم (47) لسـنة2002يشـنن تنظيم الةـحافة والطباعة والنشـر لتشـمل حح الرد والتةحيح في إطار النشر الإلكتروني. اا لاستعماا ا قانونيالنشر الإلكتروني وتكون سند | Summary : In consideration to the technological advancements and contemporary technologies used in electronic publishing, the challenge lies in determining the fine line between the protection of people’s rights and privacy on the one hand, and the freedom of opinion and expression guaranteed by international constitutions on the other hand. Under the general principles of civil liability, this study discusses the legal adaptation to compensate for harm, encompassing various issues including sectarianism, hate speech propagation, invasion of privacy, defamation, slander, attack on intellectual property, and spreading what is against the public order. The existing laws have revealed their relative shortcomings in staying abreast of the modernity of this technology, and the need to amend them has therefore emerged to keep pace with the development in electronic publishing. The study demonstrates in the first chapter the dynamics and mechanism of electronic publishing, followed by the legal implications of civil liability associated with electronic publishing. The study recommends updating the press and publishing regulations to incorporate electronic journalism, establishing a specialized online content regulatory authority for continuous scrutiny, and designating specialized courts and judges to handle electronic publishing lawsuits instead of general civil courts. Finally, the study encourages legislators to amend Article (60) of Law No. (47) of 2002 to regulate the press, printing, and publication to include electronic publishing, forming a solid legal base for the use of reply and correction rights in the context of electronic publishing. | |
