| Abstract | Abstract : The study of the criminal confrontation of the threat of AIDS and the violation of the rights of people living with it is of great importance in view of the spread of HIV/AIDS in all countries. One of the most important reasons for its rapid spread is the multiple ways in which HIV/AIDS spreads, in addition to its hidden or silent nature, which often leads to ignorance of the fact that a person is infected, causing its transfer to others without them being aware of the infection or transmission, and thus continuing to transfer to other parties until it became a threat to all societies. The transformation of the virus, whether intentional or unintentional, has participated significantly in the spread of the disease. The absence of criminal status for such conduct at the time has increased the problem because it was considered an illness where the infected person needed care and support, which resulted in the virus being transmitted to many people without any accountability However, after realizing the seriousness of this matter, countries sought to address AIDS by criminalizing any behavior that would lead to the transmission of the virus to others. Here, many legal problems arose in the area of determining criminal responsibility. Criminal law jurists were divided between those who saw the adequacy of the provisions of Crimes against Persons to deal with the case of HIV, while the other team stressed the need to introduce special laws that criminalize the deliberate transmission or causing the transfer unintentionally. In the belief of the importance of protecting society from the danger of AIDS, and to guarantee the human rights of those existing with it, the Bahraini legislature issued Law No. 1 of 2017 on the protection of society against AIDS and the protection of the rights of persons living with it Therefore, this research seeks to participate in establishing an effective criminal confrontation to ensure society's protection against the threat of AIDS and the protection of the rights of people living with HIV (PLWH) by identifying the Bahraini legislature's plan, reviewing the methods of criminal confrontation that have been adopted, and determining their adequacy and effectiveness. It also aims to study the approach the legislature has taken to address violations against people living with AIDS, in order to ensure their human dignity and equality with their peers in society and to eliminate all forms of stigma or discrimination against them. The fundamental fact is that this war is against AIDS and not against people living with it | |
