| Abstract | Abstract : This study aims to analyze the mediation system for resolving civil and commercial disputes under Bahraini law by examining the legal and regulatory framework, along with its conditions, types, and effects. The theoretical significance of the study lies in clarifying the general principles of mediation as an alternative mechanism for achieving expedited justice, efficiently resolving disputes, and maintaining amicable relationships between parties. Practically, the study highlights the role of mediation in supporting Bahrain's Economic Vision 2030, which emphasizes sustainability, competitiveness, and fairness, by assessing the effectiveness of the current legal framework in encouraging parties to adopt mediation and enhancing the investment environment in Bahrain. To achieve these objectives, the study employed descriptive, analytical, and comparative methodologies. It analyzed the relevant legal provisions in Bahraini law and compared them to mediation legislations such as Jordanian Law No. 12 of 2006 and UAE Federal Law No. 40 of 2023. The focus was placed on identifying similarities and differences between these legislations and their alignment with the goals of efficiently and effectively resolving disputes. The study's main research problem revolves around evaluating the adequacy of Bahraini legal regulations in achieving the objectives of mediation, identifying its role as an effective alternative to arbitration, and analyzing its impact on attracting foreign investment. Additionally, it addressed the legal nature of mediation agreements and the role of Bahraini courts in supporting and regulating the mediation process. The study concluded with a set of findings and recommendations aimed at enhancing awareness and trust in the mediation system, supporting Bahraini legislation to align with international best practices, and ensuring the activation of mediation's role in achieving expedited justice and promoting national economic growth Keywords: Dispute resolution, mediation, civil disputes, commercial disputes, e-commerce disputes, bankruptcy disputes | |
